Importer Security Filing and Additional Carrier Requirements
On January 26, 2010 the new rule titled Importer Security Filing (ISF) and Additional Carrier Requirements (commonly known as “10+2”) changed from informed to enforced compliance. This new rule applies to import cargo arriving to the United States by vessel. Failure to comply with the new rule could ultimately result in monetary penalties (min. $ 5000), increased inspections and delay of cargo.
Under the new rule, before merchandise arriving by vessel can be imported into the United States, the Importer Security Filing (ISF) Importer or their agent must electronically submit certain advance cargo information to US Customs and Border Protection (CBP). This requirement only applies to cargo arriving in the United States by ocean vessel - it does not apply to cargo arriving by other modes of transportation – and only for the vessel destined to the United States.

Failure to provide US Customs and Border Protection with the required information may result in liquidated damages of $ 5000 per violation for the submission of an inaccurate, incomplete or untimely filing. Please be also informed that the Bond Holder will be held liable for accuracy of the information filed and any occurring penalties. If payment is denied the surety company pays and charges the fines to the bond. Failure to reimburse the surety company will eventually lead to termination of the bond.
